1. Introduction
These Terms of Service ("Terms") govern your access to and use of MyChatterBox ("MCB," "we," "us," or "our") website and Services, including Fluency Lab — Group, Fluency Lab 101 (1-on-1), and Fluency Lab — Career Advancement (collectively, the "Services").
By booking a consultation, purchasing a program, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
MyChatterBox is based in Thailand.
2. Eligibility
MCB does not restrict enrollment by age. Instead, eligibility is determined by **English proficiency level**: applicants must demonstrate at least an **A2 (elementary) level** of English, assessed during the consultation process, to enroll in any program.
If a prospective student is a minor, [Placeholder — guardian consent/registration process to be confirmed with legal counsel].
3. Our Services
3.1 Consultation-First Enrollment
Access to MCB programs is by consultation only. Prospective students must complete a consultation before receiving a program recommendation and private payment link. MCB reserves the right to decline enrollment or recommend a different program based on the consultation outcome.
3.2 Program Structure
Our Services are organized into four progressive modules — Activation, Expansion, Refinement, and Mastery — delivered through Group, 101, or Career Advancement formats as described on our website. Session structure, curriculum content, and scheduling are determined by MCB and may be adjusted to improve learning outcomes.
3.3 No Guarantee of Outcomes
MCB is designed to build conversational fluency and confidence through structured exposure and practice. We do not guarantee specific proficiency outcomes, test scores, or timeframes for improvement, as language acquisition varies by individual.
4. Payments
4.1 Payment Methods
Payments are processed via Stripe (card payments) or direct bank transfer, using a private payment link issued after your consultation.
4.2 Packages
Programs may be purchased as single-module or multi-module packages, as recommended during your consultation. Pricing and package details will be confirmed in writing (email or payment page) prior to payment.
4.3 Refunds, Pauses, and Transfers
[Placeholder — refund, pause, and transfer policy to be finalized. Until confirmed, no refunds are guaranteed for any purchased sessions or packages. Please refer to the specific terms provided at the time of purchase, or contact us directly with questions.]
4.4 Returning Students
Students returning within 12 months of their last session may re-enroll without a full new consultation. Students returning after 12 months will be treated as new applicants and must complete a new consultation.
5. Scheduling, Attendance, and Cancellations
- Session times are confirmed at enrollment based on your intake group (e.g., Monday/Thursday, Tuesday/Friday, Saturday/Sunday).
- [Placeholder — policy for missed sessions, late cancellations, rescheduling, and makeup sessions to be finalized.]
- MCB reserves the right to reschedule or substitute mentors when necessary, with reasonable notice where possible.
6. Code of Conduct
To maintain a safe, respectful, and emotionally supportive learning environment, all students and mentors agree to:
- Treat other participants and mentors with respect and courtesy
- Refrain from harassment, discrimination, or abusive behavior of any kind
- Participate in good faith in group activities and rituals
- Maintain confidentiality regarding personal information shared by other students during sessions
MCB reserves the right to remove any participant from a session or program, without refund, for conduct that violates these principles or disrupts the learning environment for others.
7. Intellectual Property
All curriculum materials, including but not limited to session structures, topic banks, activity banks, pattern banks, module frameworks, and branded program names ("Fluency Lab," "Activation," "Expansion," "Refinement," "Mastery," and related terms) are the exclusive intellectual property of MyChatterBox.
Students and mentors may not copy, reproduce, distribute, or create derivative works from MCB's curriculum materials for any purpose outside their personal participation in the Services, without prior written consent from MCB.
Any session recordings, portfolio videos, or feedback generated during your participation remain subject to this policy; usage rights (e.g., MCB's ability to use anonymized excerpts for marketing) will be addressed via separate consent where applicable.
8. Mentor Relationship
Mentors (Speaking Buddies, Fluency Guides, and Fluency Designers) are representatives of MCB and deliver sessions according to MCB's curriculum and philosophy. Mentors are not permitted to offer services outside the MCB platform to enrolled students in a manner that circumvents these Terms.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- MCB provides the Services on an "as is" and "as available" basis.
- MCB is not liable for indirect, incidental, or consequential damages arising from your use of the Services.
- MCB's total liability for any claim related to the Services shall not exceed the amount you paid for the specific program giving rise to the claim.
[Placeholder — to be reviewed and finalized by legal counsel, particularly regarding applicable consumer protection laws in Thailand.]
10. Termination
MCB reserves the right to suspend or terminate a student's access to the Services for violation of these Terms, including the Code of Conduct, without refund of remaining sessions.
Students may discontinue participation at any time; however, this does not automatically entitle the student to a refund (see Section 4.3).
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated where reasonably possible.
12. Governing Law and Disputes
[Placeholder — governing law, jurisdiction, and dispute resolution process (e.g., mediation, arbitration, or courts of Thailand) to be finalized with legal counsel once MCB is formally registered.]
